DMCA Policy

1. Overview

HappyMod respects the intellectual property rights of others and expects users, developers, uploaders, partners, and visitors to do the same. This DMCA Policy explains how HappyMod handles claims of copyright infringement, how copyright owners may submit takedown notices, how affected users may submit counter-notifications, and how HappyMod addresses repeat infringement.

This policy is intended to comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512, and other applicable copyright laws.

2. Copyright Infringement Policy

HappyMod does not knowingly permit copyright-infringing content on its platform. If HappyMod receives a valid copyright infringement notice, it may remove, disable access to, restrict, or otherwise take action regarding the allegedly infringing material.

Materials that may be subject to removal include, but are not limited to:

  • Apps, APK files, mods, patches, or modified software
  • Game files, assets, or downloadable content
  • Images, icons, descriptions, screenshots, videos, or text
  • User-submitted posts, comments, listings, or metadata
  • Any other content alleged to infringe a copyright owner’s rights

HappyMod may also suspend or terminate user accounts, uploader privileges, or access to the platform where appropriate, including for repeat infringement.

3. Submitting a DMCA Takedown Notice

If you believe that material available on or through HappyMod infringes your copyright, you may submit a written DMCA takedown notice to HappyMod’s designated copyright agent using the copyright reporting process made available by HappyMod.

To be effective under the DMCA, a takedown notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.

  2. Identification of the copyrighted work claimed to have been infringed.
If multiple copyrighted works are covered by a single notice, you may provide a representative list of those works.

  3. Identification of the allegedly infringing material and information reasonably sufficient for HappyMod to locate the material.
This should include the specific title, page, file name, listing, or other identifying details necessary to find the content.

  4. Information reasonably sufficient to allow HappyMod to communicate with the complaining party.

  5. A statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.

  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

A DMCA notice should be complete, accurate, and specific. Incomplete notices may delay processing or may not be actionable.

4. Review and Takedown Procedure

After HappyMod receives a DMCA notice, HappyMod may take one or more of the following actions:

  • Review the notice for completeness and facial validity
  • Remove or disable access to the allegedly infringing material
  • Notify the user, uploader, or account holder responsible for the material
  • Request additional information when necessary
  • Preserve relevant records as required or permitted by law
  • Take account-level action where appropriate

HappyMod may act quickly after receiving a valid notice and is not required to make a legal determination regarding ownership, infringement, fair use, licensing, or other defenses before removing or disabling access to material.

Removal or disabling of material does not necessarily mean that HappyMod agrees that infringement occurred.

5. Counter-Notification Process

If your content was removed or disabled because of a DMCA notice and you believe the removal was the result of mistake or misidentification, you may submit a written counter-notification through the process made available by HappyMod.

To be effective under the DMCA, a counter-notification must include all of the following:

  1. Your physical or electronic signature.

  2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.

  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Information reasonably sufficient to allow HappyMod to communicate with you.

  5. A statement consenting to the jurisdiction required by 17 U.S.C. § 512(g)(3) and agreeing to accept service of process from the person who submitted the original DMCA notice or that person’s agent.

Counter-notifications must be accurate and complete. Submitting false or misleading information may result in legal liability and account-related action.

6. Restoration of Removed Material

If HappyMod receives a valid counter-notification, HappyMod may forward it to the party that submitted the original DMCA notice.

Unless the original complaining party notifies HappyMod that it has filed an action seeking a court order to restrain the affected user from engaging in infringing activity, HappyMod may restore the removed material or re-enable access to it after the period required by the DMCA, generally not less than 10 business days and not more than 14 business days after the counter-notification is forwarded.

HappyMod may decide not to restore material where restoration would violate applicable law, platform rules, security requirements, or other legal obligations.

7. Repeat Infringer Policy

HappyMod maintains a policy for terminating, in appropriate circumstances, users or account holders who are repeat infringers.

Actions may include:

  • Removal of infringing content
  • Restriction of upload or publishing privileges
  • Temporary suspension of account access
  • Permanent account termination
  • Blocking further submissions of the same or similar infringing material
  • Other measures HappyMod determines are appropriate

HappyMod may consider multiple factors when determining whether a user is a repeat infringer, including the number of valid complaints, the nature of the content, the user’s history, counter-notification outcomes, and evidence of bad-faith activity.

8. Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.

Do not submit a DMCA notice or counter-notification unless you are certain that the information you provide is accurate and that you have the legal right to submit it.

9. Fair Use and Other Defenses

HappyMod cannot provide legal advice or determine whether a particular use qualifies as fair use, licensed use, public domain use, or another legally protected use.

If you are unsure whether material infringes your copyright, or whether your own material was removed by mistake, you should seek independent legal advice before submitting a DMCA notice or counter-notification.

10. No Waiver of Rights

Nothing in this DMCA Policy limits HappyMod’s rights or remedies under applicable law. HappyMod reserves the right to remove or disable access to any material at its discretion, including material that may violate laws, third-party rights, platform rules, security standards, or user safety requirements, even if the material is not the subject of a DMCA notice.

11. Changes to This Policy

HappyMod may update this DMCA Policy from time to time. Changes become effective when posted. Continued use of HappyMod after changes are posted means you accept the updated policy.
